●The City of Shibushi’s Comprehensive Disaster Prevention Hazard Map (website version) (hereinafter called this “Website”) is a Website that the user can access via a computer or smartphone to browse hazard area maps for different types of disasters, tsunamis and landslides, in the City of Shibushi.
Please read these Terms of Use carefully before accessing or using this Website.
If you accept and agree to be bound and abide by the Terms of Use after closely reviewing their content, please click the “I accept” button at the bottom of the page.

These Terms of Use shall constitute a legally binding contract between the user of this Website (hereinafter called the “User”) and the City of Shibushi concerning the use of the Data. Article 1.1 The copyright of the Data shall belong to Zenrin Co., Ltd. (“Zenrin”) or a third party who grants to Zenrin the right to use it.
Article 1.2 The City of Shibushi shall grant to the User the following rights concerning the Data within the scope of private use as defined in Japan’s Copyright Act; provided, however, that the User shall not acquire any other rights to the Data.
(1) To view the Data shown on this Website by using a Website browser.
(2) To print out the Data shown on this Website on paper media. (The Data printed out in accordance with this item shall be hereinafter called the “Reproduced Data”.)
(Compliance Rules)
Article 2. The User shall comply with the following rules:
(1) Except where expressly permitted in the preceding Article, the User shall not reproduce (or copy), transcribe, extract, process, modify, adapt, transmit or use in any other way the Data, in whole or in part, by any means whatsoever.

Article 3. The User shall acknowledge that the Data may not necessarily satisfy the User’s purpose of use or requirements and that all of the Data may not be accurate and complete. The User agrees that the City of Shibushi shall not be liable for the replacement or repair of the Data, or refund relating thereto, and also that the City of Shibushi shall not assume any other responsibilities.
(Discontinuation of this Website)
Article 4.1 The City of Shibushi may temporarily discontinue this Website’s services in whole or in part during the regular maintenance and inspection of this Website.
Article 4.2 The City of Shibushi may temporarily discontinue the operation of this Website in whole or in part without prior notice to the User if any of the following conditions applies:
(1) If this Website needs to be maintained or inspected on an emergency basis
(2) If it becomes impossible for the City of Shibushi to continue the operation of this Website due to an accident such as fire and power failure, an natural disaster such as earthquake and flood, war, riot or labor dispute, among other things
(3) If the City of Shibushi determines it is necessary to temporarily discontinue the operation of this Website for operational or technical reasons
(4) If it becomes impossible for the City of Shibushi to continue the operation of this Website due to the failure thereof, etc.
Article 4.3 The City of Shibuhi may terminate the operation of this Website at its own discretion.
<Information about Landslide Disasters>
1 The Landslide Disaster Alert Areas and the Landslide Disaster Special Alert Areas are those areas where the safety of area residents may be endangered by steep slope failures or debris flows if they occur. They are designated by the Prefecture of Kagoshima, based on Japan’s Act for Promotion of Measures to Prevent Sediment Disasters in Sediment Disaster Alert Areas, etc. (commonly called “the Sediment-related Disaster Prevention Act”).
2 The Mountain Disaster Hazard Area is shown based on the results of a survey carried out by Kagoshima Prefecture on areas that are likely to cause direct damage to public facilities and houses such as government offices, schools, hospitals, and roads due to the collapse of mountainous areas, landslides, and spills of sediment failure.
<Information about Tsunamis>
1 The area that is expected to be flooded by the L2 tsunami is based on the tsunami inundation forecast map of the Kagoshima Prefecture Earthquake and Other Disaster Damage Prediction Survey released by the Crisis Management Bureau in March 2013.
2 The area expected to be flooded by the L2 tsunami is the largest-class tsunami that can be considered at this time, with Kagoshima Prefecture's own consideration being added to two cases of the estimated huge earthquake in the Nankai Trough announced by the government that have a large impact on Kagoshima Prefecture.
3 The L2 tsunami inundation zone shows the inundation area, which is expected to be flooded in the event of a maximum class tsunami under bad conditions, and the depth of inundation, which is the largest depth of water at each point in the inundation area, and the inundation area and depth of the tsunami are not the first of the tsunamis, but the largest after the second.

2 志布志市は、利用者に対して、著作権法に定める私的使用の範囲内で、データについて以下の権利を許諾します。なお、利用者はデータについて、これら以外のいかなる権利も取得するものではありません。
(1)本サイト上で表示されたデータをWebブラウザで閲覧すること。
(2)本サイト上で表示されたデータを紙媒体に印刷出力すること(本号に基づき印刷出力したデータを以下「複製成果」という)。
(遵守事項)
第2条 利用者は以下の事項を遵守するものとします。
(1)前条で明示的に許諾される場合を除き、方法の如何を問わず、データの全部又は一部を複製(印刷を含む)、転記、抽出、加工、改変、翻案、送信その他の利用をしないこと。
(2)有償・無償を問わず、また、譲渡、使用許諾、送信その他方法の如何を問わず、データ(その全部又は一部の複製物、出力物、抽出物その他利用物を含む)を第三者に利用させないこと。
(保証)
第3条 利用者は、データは必ずしも利用者の使用目的又は要求を満たすものではなく、又すべてが正確かつ完全ではないこと及び志布志市はこれらがあってもデータの変換・修補・代金返還その他の責任を負わないことを了承するものとします。
(本サイトの停止)
第4条 志布志市は定期的に本サイトの保守・点検を行う際、一時的に本サービスの全部又は一部を中断することができるものとします。
2 志布志市は、次の各号のいずれかに該当する場合は、利用者に事前の通知をすることなく、一時的に本サイト運営の全部又は一部を中断することができるものとします。
(1)本サイトの保守・点検を緊急に行う場合。
(2)火災・停電等の事故、地震・洪水等の天災、戦争、暴動、労働争議等により、本サイトの運営が不可能となった場合。
(3)志布志市が、運用上又は技術上やむを得ず本サイトの運営一時中断が必要であると判断した場合。
(4)本サイトの障害等により、本サイトの運営ができなくなった場合。
3 志布志市は、志布志市の裁量によって、本サイトの運営を終了することができるものとします。
<土砂災害に関する情報>
1 土砂災害警戒区域(イエローゾーン)及び土砂災害特別警戒区域(レッドゾーン)は、土砂災害警戒区域等における土砂災害防止対策の推進に関する法律に基づき、がけ地の崩壊や土石流が発生した場合に住民に危害が生じる恐れのある区域として鹿児島県が指定した区域です。
2 山地災害危険地区は、山地から発生する山腹の崩壊、地すべり及び崩壊土砂の流出などにより、官公署・学校・病院・道路等の公共施設や人家等に直接被害を与えるおそれがある地区について、鹿児島県が行った調査結果をもとに示しています。
<津波に関する情報>
1 L2津波浸水想定区域は、平成25年3月に危機管理局が公表した鹿児島県地震等災害被害予測調査の津波浸水想定図に基づいています。
2 L2津波浸水想定区域は、国が公表した南海トラフの巨大地震想定のうち、鹿児島県への影響が大きい2つのケースに、鹿児島県独自の検討を加えたもので、現時点において考え得る最大クラスの津波です。
3 L2津波浸水想定区域は、最大クラスの津波が悪条件下において発生した場合に浸水が予想される浸水域と、浸水域内における各地点の最大の水深である浸水深を示したものであり、浸水域や浸水深は、津波の第1派ではなく、第2派以降に最大となる場所もあります。
